1. Scope
1.1 These general terms and conditions (GTC) apply to the organization of courses, workshops, seminars, retreats, fitness/yoga offers and other events (hereinafter: “Retreat”) by the organizer Pohl & Zimmermann Lda. (hereinafter: “Oakstone Hills”), regardless of the location of the booked retreat.
1.2 The following conditions govern the booking of the retreat.
1.3 Oakstone Hills is exclusively responsible for organizing and running the retreat. Oakstone Hills is not a tour operator or travel agent.

3. Minimum age
3.1 The minimum age for booking and participating in retreats is 18 years.
3.2 The participation of children and adolescents must be clarified with Oakstone Hills in advance and, if Oakstone Hills has given consent, requires the accompaniment of a parent or guardian.
4. Offer, acceptance, conclusion of contract
4.1 The description of Oakstone Hills on the website www.oakstone-hills.com represents a legally binding offer (offer).
4.2 The subscriber's paid order represents acceptance of the offer and thus the purchase contract.
4.3 After acceptance of Oakstone Hills' offer by placing an order from the participant, the participant will receive a confirmation of registration by email. This email contains the order and payment details and the invoice can be found in this email (order confirmation).
4.4 The content of the purchase contract is based on the content of the order confirmation and the general terms and conditions.
5. Contract language and storage of the contract text
5.1 The contracts can be concluded in English in German and international courses.
5.2 The general terms and conditions of Oakstone Hills can be found on the website www.oakstone-hills.com under “Terms and Conditions.” The document can be printed out and viewed.
5.3 The contract text is stored in the order confirmation email at Oakstone Hills. This contract text will be made available to the participant upon request.
6. Payment of the course fee
6.1 The participant books the retreat via the Oakstone Hills website. The purchase price is to be paid immediately upon booking. The prices listed on the website are final prices and include the applicable value added tax.
6.2 The guest is offered various payment methods.
7. Participants' rights and obligations
7.1 The participant is obliged to provide their personal data truthfully and completely during the ordering process. The participant undertakes to immediately report changes to their data, such as e-mail address, name, address and telephone number.
7.2 The participant must fulfill the requirements for participation in the retreat on their own responsibility and at their own expense. This applies in particular to booking means of transport.
7.3 The participant is informed that Oakstone Hills expressly refuses to book third-party services (such as arrival and departure, train booking, flight, food, alternative program) before the cancellation period of three weeks before the start of the course due to failure to reach the minimum number of participants, unless the participant has been expressly informed by Oakstone Hills that the minimum number of participants has been reached before this time.
7.4 Participation in the retreat requires normal mental and physical resilience. If the participant is undergoing medical or psychotherapeutic treatment, he is recommended to discuss the participation with the doctor or therapist.
7.5 The participant is required to inform Oakstone Hills and the course instructor of any physical or mental disabilities or complaints before starting the retreat.
7.6 The participant is not entitled to have the retreat carried out by specific teachers. In the event of a short-term, unforeseeable absence of the announced teacher due to illness or disability, Oakstone Hills can provide a substitute teacher for the booked retreat. The replacement of the teacher does not entitle the participant to withdraw from the contract or to cancel the contract.
8. Oakstone Hills' rights and obligations
8.1 The scope of services to be provided by Oakstone Hills extends exclusively to the implementation of the retreat. Oakstone Hills owes no further benefits.
8.2 Oakstone Hills is entitled to change the course or content of a retreat or to omit individual modules as long as the aim and overall character of the retreat are not changed as a result.
8.3 Oakstone Hills is entitled to send the participant an informational email with summarized information about the retreat a few weeks before the start of the retreat. This email also states whether materials need to be brought along.
8.4 Oakstone Hills is entitled to use other teachers to conduct the retreat if the announced teacher is absent for reasons beyond Oakstone Hills's control. This applies in particular if the announced teacher is ill or unable to attend.
8.5 Oakstone Hills undertakes to inform the participant at least three weeks before the start of the course that the retreat has not been completed due to failure to reach the minimum number of participants. Oakstone Hillss undertakes to immediately refund the course fee to the participant.
8.6 If the Oakstone Hills retreat cannot be held for reasons other than failure to reach the minimum number of participants, Oakstone Hills will immediately inform the participant of this and immediately refund the consideration. The participant has no further claims. In particular, Oakstone Hills is not obliged to reimburse the participant for cancellation or rebooking costs for transports already provided.
9. No right of withdrawal for retreats
There is no right of withdrawal for consumers. Booking a retreat is a leisure activity. There is no right of withdrawal for such services.
10. Cancellation reservation if the minimum number of participants is not reached; Oakstone Hills right of withdrawal
10.1 Retreats offered by Oakstone Hills will only be carried out if the minimum number of participants specified in the offer is reached and within the specified withdrawal period.
10.2 If this specified minimum number of participants is not reached, Oakstone Hills may withdraw from the contract no later than three weeks before the start of the retreat, provided that:
— Oakstone Hills has specified the minimum number of participants and the latest withdrawal period in the offer description; and
— this is also clearly stated in the order confirmation email.
10.3 Oakstone Hills will immediately refund the course fee to the participant.
10.4 There are no further claims on the part of the participant.
11. Short term cancellation by Oakstone Hills
Oakstone Hills reserves the right to postpone or cancel the retreat for reasons beyond Oakstone Hills's control, in particular if the instructor is ill, for which no compensation is possible, or in the event of force majeure. The course fee will be refunded. Further claims are excluded.
12. Withdrawal by the participant — cancellation costs
Cancellations are possible at any time. There is lump sum compensation unless Oakstone Hills is at fault or force majeure:
Up to 60 days before the start of the course: 50% of the price.
59 days or less: 100% of the price
The participant is free to prove minor damage.
13. Substitute participant
A substitute participant can be named. Oakstone Hillss may refuse the nomination for reasons of cost or lack of suitability. Original and substitute participants are jointly and severally liable.
14. Room occupancy
When accommodating in twin rooms, Oakstone Hills strives to provide gender-segregated occupancy. However, no guarantee can be given for this.
15. Right of withdrawal; termination due to special circumstances
15.1 There are legal rights of withdrawal.
15.2 A change of teacher does not entitle you to resign.
15.3 In cases of force majeure, both parties may cancel the contract.
15.4 Oakstone Hills may also cancel the contract if the participant's conduct disrupts the course of the retreat.
16. Liability
16.1 Participation in the retreat is at your own risk.
16.2 The organizer is only liable in case of intent and gross negligence. For simple negligence, liability is limited to foreseeable damage typical of the contract. This does not affect life, physical and health damage.
16.3 In the event of simple negligence, liability is limited to the foreseeable damage typical of the contract.
16.4 No liability is assumed for services provided by third parties.
17. Declaration of consent in pictures and videos
17.1 Oakstone Hills may use image/video recordings for advertising purposes.
17.2 The participant automatically gives his consent, unless he personally withdraws this consent before recording.
18. Transfers and additional services
18.1 After completing the booking, participants can book additional services (e.g. airport transfers) via the customer portal.
18.2 These additional services are not included in the retreat price and must be paid separately.
18.3 Payment is made immediately after booking the additional service. If payment is not made on time, Oakstone Hills reserves the right to collect the outstanding amount via the payment provider used at the retreat (Stripe).
19. Travel insurance
Oakstone Hills expressly recommends that guests take out travel cancellation insurance and international travel health insurance. In the event of cancellation, illness or other unforeseen events, these insurance policies can help to cover costs and make your stay carefree. The conclusion and administration of such insurance policies is the sole responsibility of the guest.
20. House rules
19.1 Valuables brought along remain the responsibility of the guests.
19.2 Respectful treatment of others, nature and the environment is mandatory.
19.3 Smoking is only permitted in designated areas.
19.4 Alcohol consumption in moderation is permitted; misuse results in exclusion without a claim for reimbursement.
21. Applicable law, jurisdiction
20.1 Portuguese law applies.
20.2 If the customer is a merchant or legal entity under public law without jurisdiction in Portugal, Viseu is the exclusive place of jurisdiction.
